Missouri Court of Appeals, Eastern District / Feb 14, 2023
Sharon Dash, et al., Appellants, vs. Tressa Mitchell, et al., Respondents.
Appellants, Trustees of a Homeowners Association, appealed the trial court's judgment granting Respondent Tressa Mitchell's motion to set aside a default judgment. The default judgment had been entered against Mitchell for violating HOA covenants. The appellate court reversed, finding the trial court abused its discretion by concluding Mitchell demonstrated good cause to set aside the default, as her actions showed a deliberate lack of care. The court also granted Appellants' motion for attorneys' fees on appeal and remanded the case for their calculation.
