Marilyn Washington vs. Sioux Chief MFG. CO., Inc.
Marilyn Washington sued Sioux Chief Manufacturing Co., Inc. for employment discrimination and retaliation under the Missouri Human Rights Act. The trial court entered a default judgment against Sioux Chief as a sanction for repeated discovery violations and awarded damages. On appeal, the Western District affirmed the trial court's discovery sanctions, preclusion from the damages hearing, and finding that Sioux Chief waived its right to a jury trial on damages. However, the court reversed the damages award, holding that the trial court plainly erred by exceeding the statutory cap, and remanded for recalculation of damages.
