S.M.H. obtained a default judgment against a former teacher of the Transitional School District and sought to satisfy it from Missouri's Legal Expense Fund. The circuit court granted summary judgment for S.M.H., ordering the State to authorize payment from the Fund. The Missouri Supreme Court reversed, holding that the Special Administrative Board of the Transitional School District is not an "agency of the state" for purposes of the Legal Expense Fund. Therefore, the Fund has no obligation to satisfy the judgment against the district employee.
