Missouri Court of Appeals, Eastern District / Mar 10, 2020
S.M.W., Respondent, vs. V.M., Appellant.
Guardian S.M.W. obtained a Full Order of Protection for a minor child against V.M. based on allegations of stalking. The trial court granted the order despite stating it was "not convinced of what happened during that ten-day period" of the child's disappearance. On appeal, V.M. argued the judgment was not supported by substantial evidence. The appellate court reversed, finding insufficient evidence of "alarm" or "stalking" as required by statute, and that the trial court erroneously applied the law.
