Missouri Court of Appeals, Western District / Dec 10, 2019
Ryan Ferguson vs. St. Paul Fire and Marine Insurance Company, et al
Ryan Ferguson sued the City of Columbia and its police officers for constitutional violations and malicious prosecution, securing a large judgment. He then sought equitable garnishment against the City's insurers, St. Paul Fire & Marine Insurance Company and Travelers Indemnity Company, who denied coverage. The circuit court granted partial summary judgment to Ferguson, awarding equitable garnishment. On appeal, the Western District affirmed, holding that St. Paul's injury-based policy provided coverage for injuries sustained during the policy period, even if the wrongful acts occurred earlier. The court also denied Ferguson's cross-appeal regarding the interest rate due to a lack of preservation.
