Lynnetta Scales appealed the dismissal of her wrongful death claim against Places for People, Incorporated, for failure to state a claim. Scales's former spouse, a client of Places for People, was struck and killed by a vehicle while walking on a public road. Scales alleged Places for People had a statutory duty to involuntarily commit Decedent, a common law duty to ensure his safety, and an assumed duty by conduct. The appellate court affirmed the dismissal, finding that Scales failed to plead sufficient facts to establish any of the alleged duties.
