State v. Harris
The State of Missouri appealed a circuit court order dismissing with prejudice some, but not all, charges against Semaj Harris. The Missouri Supreme Court dismissed the State's appeal, holding that the circuit court's order was not a final, appealable judgment because it did not adjudicate all counts in the multi-count indictment. The Court reaffirmed that the State's right to appeal in criminal cases under § 547.200.2 requires a final judgment, and the circumstances did not warrant treating the improper appeal as an application for an original writ.
