State ex rel. Monsanto Company, Relator Missouri Cases

Monsanto Company sought a writ of prohibition or mandamus to compel the St. Louis City circuit court to transfer venue for five of six plaintiffs' tort claims to St. Louis County. The circuit court had refused to transfer venue. The Supreme Court of Missouri made its preliminary writ permanent for five plaintiffs, holding that venue for corporations in tort actions where the plaintiff was first injured outside Missouri is determined by the registered agent's location at the time suit is filed. However, the Court denied relief for the sixth plaintiff, finding Monsanto waived its venue objection by failing to file a timely motion to transfer.
