Supreme Court of Missouri / Apr 30, 2019
State ex rel. Travis Jones, Relator, vs. The Honorable Eric Eighmy, Respondent.
Travis Jones sought a writ of prohibition to prevent the circuit court from holding a probation revocation hearing, arguing the court lost authority after his earned probation discharge date passed without a hearing. Jones, who was incarcerated in a nearby county, was not brought before the court for the scheduled hearing. The Supreme Court of Missouri agreed, making the writ permanent and ordering Jones's discharge from probation, finding the circuit court failed to make every reasonable effort to conduct the hearing before the probation term expired.
