Felix M. Seals sought a writ of prohibition to prevent the trial court from prosecuting him on domestic assault (Count I) and victim tampering (Count III), arguing that Count I was barred by double jeopardy and Count III was contingent on Count I. The appellate court quashed its preliminary writ of prohibition. It found the issue regarding Count I moot because the State had already withdrawn the charge, and held that the victim tampering charge (Count III) could proceed independently as a stand-alone offense.
