State of Miswsouri vs. William (Billy) Carter
William Carter, committed to the Department of Mental Health after pleading not guilty by reason of mental disease or defect (NGRI) and also as a sexually violent predator (SVP), appealed the trial court's denial of his application for conditional release under section 552.040.10 as moot. The trial court reasoned that any relief granted would be ineffectual due to his concurrent SVP commitment. The appellate court reversed and remanded, holding that an application for conditional release from an NGRI commitment is not moot simply because of a concurrent SVP commitment, as removing one basis for confinement provides effectual relief.
