Steven Brunnworth appealed the denial of his Rule 24.035 motion for post-conviction relief, arguing his amended motion was timely filed and his plea counsel was ineffective. The appellate court found that Brunnworth's amended motion was untimely filed. Because the motion court failed to conduct an independent inquiry into whether Brunnworth was abandoned by post-conviction counsel, the appellate court reversed the judgment and remanded the case for such an inquiry.
