Tonda Hill vs. Steven Freedman
Tonda Hill sued her former supervisor, Steven Freedman, for negligence after a car accident in Missouri. The trial court dismissed Hill's negligence claim with prejudice, finding that Kansas law applied because Hill had received workers' compensation benefits under Kansas law, and under Kansas law, her claim was barred by the Kansas Workers Compensation Act and the Kansas Tort Claims Act. The appellate court affirmed the dismissal, agreeing that Kansas law governed the claim and precluded Hill from suing Freedman for negligence.
