State of Missouri vs. Steven Wayne Cooper
Steven Wayne Cooper appealed the circuit court's denial of his "First Amended Motion to Dismiss Charges as Unconstitutional and Summary Judgment on the Pleadings" in a felony failure to register as a sex offender case. The appellate court dismissed the appeal, holding that the denial of such a motion is not a final judgment in a criminal case from which an appeal can be taken. A final judgment in a criminal case occurs upon sentencing or a pre-trial order of dismissal or discharge that forecloses further prosecution.
