Kiara Standifer and Quentina Tate, consumers who purchased Hyundai vehicles, sued Suntrup Hyundai, Inc. and Hyundai Motor America Corp. after their vehicles were stolen, alleging violations of the Missouri Merchandising Practices Act. Suntrup moved to compel arbitration based on signed agreements, but the circuit court denied the motion. The appellate court vacated the circuit court's judgment, holding that the arbitration agreements were enforceable and Suntrup had not waived its right to arbitrate, and remanded the case with instructions to compel arbitration.
