Susan Brands, Respondent, v. Savvy Surrounding Style, LLC, Appellant.
Susan Brands (Client) sued Savvy Surrounding Style, LLC (Designer) for breach of contract and violations of the Missouri Merchandising Practices Act (MMPA) after their interior design relationship ended. The jury found for Client on both claims, and the trial court awarded damages and attorney fees. The appellate court reversed the MMPA claim and the associated attorney fees, holding that Client failed to present evidence of Designer's intent not to perform a false promise, which is required for an MMPA false promise claim. However, the court affirmed the jury's damages award for the breach of contract claim, finding sufficient evidence was presented.
