Missouri Court of Appeals, Eastern District / Sep 6, 2022
Jennifer Jacobson, Appellant, v. Syberg's Eating and Drinking Company, Inc., and Division of Employment Security, Respondents.
Jennifer Jacobson appealed an order from the Labor and Industrial Relations Commission that dismissed her application for review of a decision disqualifying her from unemployment benefits. The Commission had found her appeal untimely, as it was filed one day after the mandatory statutory deadline. The Court of Appeals dismissed Jacobson's appeal, holding that the statutory time limits for seeking review are mandatory and strictly enforced. Consequently, the Commission, and derivatively the appellate court, lacked jurisdiction to hear the untimely appeal.
