Missouri Court of Appeals, Eastern District / Dec 4, 2018
Terrance Covington, Appellant, vs. State of Missouri, Respondent.
Terrance Covington appealed the denial of his Rule 29.15 motion for post-conviction relief, following his convictions for first-degree robbery and armed criminal action. He alleged ineffective assistance of trial counsel, arguing counsel created a conflict of interest by making a record of the decision not to call a witness and was ineffective for failing to call that witness. The Eastern District of the Missouri Court of Appeals affirmed the motion court's judgment, finding no actual conflict of interest and that the decision not to call the witness was reasonable trial strategy and did not prejudice Movant.
