Tesla, INC. vs. Assurance Town and Recovery, LLC.
Tesla, Inc. filed a petition for replevin and damages against Assurance Tow & Recovery, LLC, after Assurance towed a leased Tesla vehicle and claimed title. The trial court sanctioned Assurance for contumacious behavior during litigation, striking its defenses and dismissing its counterclaim, after which the parties entered a consent judgment awarding title to Tesla. On appeal, Assurance challenged the sanctions. The appellate court affirmed the consent judgment, holding that the appeal of the counterclaim dismissal was moot and that the trial court did not abuse its discretion in imposing sanctions.
