Bi-State Development Agency appealed the dismissal of its petition for writs of mandamus and prohibition and de novo judicial review. Bi-State sought to compel the Missouri Commission on Human Rights (MCHR) to withdraw a right-to-sue letter issued to Scott Gustafson, arguing the MCHR lacked jurisdiction or failed to abide by a prior settlement agreement. The appellate court affirmed the dismissal, holding that under Section 213.111.1, RSMo, the MCHR is mandated to issue a right-to-sue letter and terminate proceedings once 180 days have passed and a request is made, regardless of unresolved jurisdictional or settlement issues.
