State of Missouri ex rel. Missouri Department of Corrections vs. The Honorable Daniel R. Green, Curcuit Judge
The Missouri Department of Corrections sought a writ of prohibition against a circuit judge who ordered the Department to release B.Z. from lifetime supervision and show cause for contempt. B.Z. had initiated the contempt proceeding, arguing the Department was violating a 2017 Permanent Injunction by applying the 2017 amendments to lifetime supervision statutes ex post facto. The appellate court made its preliminary writ of prohibition absolute, holding that the Department had complied with the plain terms of the Permanent Injunction regarding B.Z.'s Category One offenses, and therefore the circuit judge exceeded his authority.
