Relators, Ronald Prater and others, filed a petition for a writ of mandamus to compel the circuit court to transfer an underlying declaratory judgment action from Greene County to Pulaski County. The circuit court had overruled Relators' motion to transfer venue, despite none of the defendants in the declaratory judgment action residing in Greene County. The Supreme Court of Missouri made its preliminary writ of mandamus permanent, holding that Greene County was an improper venue under Section 508.010.2, RSMo, and ordered the circuit court to transfer the case to Pulaski County.
