Supreme Court of Missouri / Feb 26, 2019
Harold Lampley and Rene Frost, Appellants, vs. The Missouri Commission on Human Rights and Alisa Warren, Respondents.
Harold Lampley and Rene Frost appealed a circuit court's summary judgment in favor of the Missouri Commission on Human Rights. The Commission had terminated their discrimination claims under the Missouri Human Rights Act (MHRA), asserting that sexual orientation and association with a gay person were not protected categories. The Supreme Court reversed, holding that sex discrimination based on sex stereotyping is covered by the MHRA, and the Commission erred in mischaracterizing the claims. The case was remanded with instructions for the circuit court to direct the Commission to issue right-to-sue letters.
