Missouri Court of Appeals, Eastern District / Jul 21, 2020
Tracy Boehlein, Appellant, vs. Tim Crawford, Respondent.
Tracy Boehlein appealed two judgments dismissing her claims against Tim Crawford, her brother, concerning real property they previously co-owned. Boehlein's claims for rent, property damage, and breach of fiduciary duty were filed after the parties had settled and dismissed with prejudice a prior partition action related to the same property. The appellate court affirmed the trial court's dismissal, holding that Boehlein's claims were barred by the doctrine of res judicata and Supreme Court Rule 67.01 because they were merged into the prior partition action and its settlement.
