Missouri Court of Appeals, Western District / Mar 3, 2020

Tri-County Counseling Services, Inc, et al. vs. Office of Administration, et al.

Appellant

Tri-County Counseling Services, Inc. (Family Facets), an unsuccessful bidder, appealed a judgment denying its challenges to state contract awards. Family Facets argued it was improperly denied sheltered workshop preference points and that the trial court erred in dismissing several counts for failure to exhaust administrative remedies. The appellate court affirmed, holding that Family Facets' arrangement did not qualify for the preference and that it failed to exhaust administrative remedies by not protesting all relevant sites and issues.
