The State of Missouri appealed the circuit court's dismissal of a criminal Information against Warren Dale Branning, which charged him with making a terrorist threat, felony resisting arrest, and first-degree harassment. The circuit court dismissed the charges, finding the alleged conduct was constitutionally protected and the Information failed to charge an offense. The appellate court affirmed the dismissal, concluding that the facts alleged in the Information, even if true, did not constitute a violation of law under the charged statutes, and thus did not reach the constitutional claims.
