Western Blue Print Co., LLC vs. Myrna Roberts, Et Al.
Myrna and Mel Roberts appealed the denial of their motion to declare a judgment against them satisfied and released. The Robertses argued the judgment was conclusively presumed paid under section 516.350.1 RSMo, as no motion to revive was filed and no payments were duly entered on the record within ten years. The appellate court reversed, holding that payments on a judgment must be entered on the record of the judgment court to restart the ten-year period, and the payments made in this case were not properly recorded.
