Missouri Court of Appeals, Eastern District / Apr 13, 2021
Weston T. Loveland III, Respondent, vs. Gabriel Austin, Respondent, and Shelter Mutual Insurance Company, Appellant.
Weston Loveland sued Gabriel Austin for personal injuries. Austin's insurer, Shelter Mutual Insurance Company, denied coverage and defense. Loveland and Austin then entered into a Section 537.065 agreement and submitted the claim to arbitration, resulting in an award for Loveland. Shelter sought to intervene in the subsequent confirmation proceeding and challenged the award, arguing it had a right to intervene and that the confirmation was barred by collateral estoppel or an invalid arbitration agreement. The appellate court affirmed the trial court's judgment, holding that Shelter did not have a right to intervene and that its other arguments lacked merit.
