Missouri Court of Appeals, Western District / Feb 23, 2021
In The Interest of: A.L.W.; Juvenile Officer vs. W.W.
Father appealed a juvenile court order finding child abuse or neglect. After the trial court initially denied Father's motion to amend the judgment, it later attempted to vacate that denial and re-rule on the motion. The appellate court dismissed the appeal for lack of jurisdiction, holding that the trial court lost authority to act on the post-judgment motion after its initial denial, rendering subsequent orders void. Consequently, Father's notice of appeal, filed after the valid final judgment, was untimely.
