St Louis-Jefferson Solid Waste Management District vs. Department of Natural Resources, State of Missouri
The St. Louis-Jefferson Solid Waste Management District sought declaratory and injunctive relief against the Missouri Department of Natural Resources, challenging the Department's authority to require Financial Assistance Agreements (FAAs) for fund allocations and the validity of an associated regulation. The trial court granted summary judgment for the District. The appellate court affirmed the trial court's judgment, holding that a 2015 statutory amendment removed the Department's authority to condition fund allocations under section 260.335.2(2) on FAAs and that the regulation conflicting with this amendment was invalid. The case was remanded for a determination of the District's reasonable attorneys' fees on appeal.
